Welcome to Infinity and Beyond Aquatics. These Terms & Conditions govern your use of our website and purchases of products and services from Infinity and Beyond Aquatics.

By accessing our website, placing an order, purchasing a product or service, or otherwise doing business with Infinity and Beyond Aquatics, you agree to these Terms & Conditions and any additional policies referenced herein, including our Shipping Policy, Return & Refund Policy, Privacy Policy, and any product-specific terms displayed at the time of purchase.

If you do not agree with these terms, please do not use our website or place an order.

1. Products & Availability

Infinity and Beyond Aquatics offers aquarium equipment, supplies, foods, livestock, and related products from a variety of manufacturers, distributors, and fulfillment partners.

Product availability, pricing, specifications, images, descriptions, packaging, and inventory may change without notice.

We make reasonable efforts to provide accurate product information. However, manufacturers may change product specifications, packaging, appearance, or features without prior notice.

We reserve the right to correct errors, inaccuracies, or omissions and to cancel or modify an order affected by an obvious pricing, inventory, description, or technical error. If an affected order has already been paid, any applicable refund will be issued to the original payment method.

2. Pricing & Payment

All prices are displayed in the currency shown at checkout and are subject to change without notice.

Applicable taxes, shipping charges, specialty shipping fees, freight charges, duties, or other charges will be displayed at checkout when applicable or otherwise disclosed before purchase.

Payment must be successfully authorized before an order can be processed.

Promotional offers, coupons, discounts, and free-shipping offers may have additional restrictions and may be modified or discontinued at any time, subject to applicable law.

3. Order Acceptance

Submitting an order does not guarantee acceptance.

Infinity and Beyond Aquatics reserves the right to refuse, limit, or cancel an order when reasonably necessary, including because of suspected fraud, inventory errors, pricing errors, shipping restrictions, product availability, payment issues, or circumstances that could jeopardize the safe shipment of live animals or temperature-sensitive products.

If we cancel a paid order, the applicable amount will be refunded to the original payment method.

4. Shipping & Delivery

Shipping is governed by our current Shipping Policy, which is incorporated into these Terms & Conditions.

Products may ship directly from manufacturers, distributors, or multiple fulfillment locations. Items within the same order may arrive separately.

Shipping and delivery dates are estimates unless expressly stated otherwise.

Live animals, refrigerated products, frozen products, oversized products, and freight shipments are subject to specialized shipping requirements, charges, and restrictions.

Customers are responsible for providing a complete and accurate shipping address and ensuring that someone is available to receive time-sensitive shipments when required.

5. Live Animals

The purchase and shipment of live fish, corals, invertebrates, and other livestock involve inherent risks associated with transportation, acclimation, aquarium conditions, animal behavior, compatibility, stress, and biological variability.

Eligible livestock purchases are covered only by the Live Animal Arrival Guarantee described in our Shipping Policy and any additional terms displayed on the applicable product page.

Customers are responsible for providing an appropriate, established aquarium environment for purchased livestock, including suitable water parameters, temperature, salinity where applicable, filtration, aquarium size, diet, compatibility, and acclimation.

Unless specifically covered by an applicable written guarantee, Infinity and Beyond Aquatics cannot guarantee the continued health or survival of livestock after the applicable arrival guarantee period.

Recommendations regarding aquarium size, compatibility, feeding, care, water chemistry, or livestock behavior are provided as general guidance. Individual animals and aquarium environments vary, and no compatibility or husbandry recommendation can guarantee a particular outcome.

6. Live Animal Claims

Any claim involving livestock that arrives deceased or otherwise qualifies under an applicable arrival guarantee must comply with the procedures and time limits stated in our Shipping Policy or on the applicable product page.

Required photographs, videos, packaging, shipping information, and other documentation must be provided when requested.

Failure to submit a claim within the applicable period or provide reasonably requested documentation may result in denial of the claim.

Approved livestock claims may be resolved through replacement, store credit, or another remedy stated in the applicable guarantee.

Original shipping charges and specialty live-animal shipping charges are non-refundable except where otherwise required by law.

7. Refrigerated & Frozen Products

Refrigerated and frozen products require specialized handling and are subject to the shipping fees, delivery requirements, and applicable arrival guarantees described in our Shipping Policy.

Customers are responsible for retrieving and properly storing temperature-sensitive products promptly following delivery.

Claims regarding eligible refrigerated products must be submitted according to the applicable arrival guarantee.

Because frozen and refrigerated products are perishable, return eligibility may be restricted for health, safety, and product-integrity reasons, subject to applicable law.

8. Returns & Refunds

Returns, exchanges, refunds, cancellations, and applicable restocking requirements are governed by our current Return & Refund Policy, which is incorporated into these Terms & Conditions.

Certain products may be final sale or otherwise ineligible for return, including live animals, perishable products, refrigerated or frozen foods, opened consumables, special-order products, and other products identified as non-returnable, except where required by law or covered by an applicable guarantee.

Customers should review all applicable return requirements before returning merchandise.

9. Manufacturer Warranties

Certain products sold by Infinity and Beyond Aquatics may include warranties provided by their manufacturer.

Manufacturer warranty terms, eligibility requirements, exclusions, registration requirements, and claim procedures are determined by the manufacturer.

Unless Infinity and Beyond Aquatics expressly provides a separate written warranty, manufacturer warranties are provided by the applicable manufacturer and are subject to that manufacturer's terms.

We may assist customers with identifying the appropriate manufacturer or warranty process when possible.

10. Aquarium Equipment & Installation

Aquarium equipment, including pumps, heaters, lighting, filtration systems, controllers, plumbing components, electrical equipment, and related products, must be installed and operated according to manufacturer instructions.

Customers are responsible for ensuring equipment is appropriate for their aquarium and electrical, plumbing, structural, and environmental conditions.

Improper installation, modification, misuse, insufficient maintenance, or operation contrary to manufacturer instructions may cause equipment failure, property damage, livestock loss, personal injury, or other harm.

Professional installation should be used when appropriate.

11. Aquarium & Livestock Information

Information provided by Infinity and Beyond Aquatics through product descriptions, articles, communications, social media, customer support, or other materials is intended for general informational purposes.

Aquarium systems and livestock vary significantly. Information regarding compatibility, aquarium capacity, water chemistry, treatment, feeding, equipment selection, or animal care should not be considered a guarantee of a particular result.

Customers remain responsible for researching and determining whether a product or animal is appropriate for their aquarium.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Infinity and Beyond Aquatics will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use, misuse, installation, failure, shipment, or purchase of products sold through our business.

This may include, where permitted by law, losses involving livestock, aquarium contents, water damage, property damage, lost profits, or other consequential losses arising from equipment failure, misuse, improper installation, delayed delivery, or conditions outside our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. Customer Responsibility

Customers are responsible for selecting products appropriate for their intended use and following manufacturer instructions, warnings, maintenance schedules, and safety requirements.

Aquariums involve water, electricity, glass or acrylic vessels, pumps, heaters, plumbing, chemicals, and living organisms. Customers should take appropriate precautions to protect people, animals, and property.

14. Fraud, Abuse & Misuse

Infinity and Beyond Aquatics reserves the right to refuse future transactions or restrict access to services when reasonably necessary because of suspected fraud, payment abuse, chargeback abuse, fraudulent guarantee claims, threats, harassment, or other unlawful or abusive conduct.

We reserve the right to request reasonable documentation when investigating suspected fraudulent transactions or claims.

15. Chargebacks & Payment Disputes

Customers are encouraged to contact Infinity and Beyond Aquatics regarding an order concern before initiating a payment dispute so that we have an opportunity to investigate and resolve the issue.

We reserve the right to provide order records, tracking information, delivery confirmation, customer communications, applicable policies, and other relevant documentation to payment processors, financial institutions, or other parties involved in resolving a payment dispute.

Nothing in this section limits any rights a customer may have under applicable consumer protection or payment laws.

16. International Orders

International customers are responsible for complying with the laws, import restrictions, permits, and customs requirements of their destination country.

Import duties, VAT, taxes, brokerage charges, customs fees, and other government or carrier charges may be the customer's responsibility as described in our Shipping Policy.

Some products, including livestock, foods, chemicals, oversized products, or products subject to manufacturer restrictions, may not be available for international shipment.

17. Intellectual Property

Unless otherwise stated, original website content, branding, logos, graphics, written materials, and other materials created by Infinity and Beyond Aquatics are owned by or licensed to Infinity and Beyond Aquatics and may not be copied, reproduced, distributed, or used commercially without authorization.

Manufacturer names, trademarks, product images, and other intellectual property remain the property of their respective owners.

18. Website Use

You may not use our website for unlawful, fraudulent, abusive, or unauthorized purposes.

You may not attempt to interfere with website security, payment processing, store functionality, customer accounts, or other systems associated with Infinity and Beyond Aquatics.

19. Third-Party Services

Our website and fulfillment operations may rely on third parties, including Shopify, payment processors, shipping carriers, manufacturers, distributors, and technology providers.

Their products and services may be subject to separate terms and policies.

Infinity and Beyond Aquatics is not responsible for third-party systems or services beyond our reasonable control, except where responsibility is imposed by applicable law.

20. Force Majeure

Infinity and Beyond Aquatics will not be responsible for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, transportation interruptions, power outages, labor disruptions, government actions, emergencies, supply-chain disruptions, or similar events.

When live animals or temperature-sensitive products are involved, shipments may be delayed when conditions could reasonably jeopardize safe delivery.

21. Governing Law

These Terms & Conditions are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer protection laws provide otherwise.

Nothing in these Terms & Conditions is intended to waive rights or protections that cannot legally be waived.

22. Changes to These Terms

Infinity and Beyond Aquatics may update these Terms & Conditions from time to time.

Changes will become effective when the revised policy is posted on our website, unless otherwise required by law.

The version applicable to an order will generally be the version in effect when the order was placed.

23. Severability

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

24. Entire Agreement

These Terms & Conditions, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and any additional terms presented in connection with a specific product or transaction, constitute the applicable agreement between the customer and Infinity and Beyond Aquatics regarding use of our website and purchases from our store.
